Conditions that the organizer must meet in order to be able to take out an IPTL

Moreover, an IPT for a salaried employee is only possible under strict circumstances:

  • It must be an 'occasional' grant (not systematic, see also further below regarding the monitoring of this).
  • The grant may not take place in the last 36 months before (early) retirement
  • The annual premium is limited (see table above). Personal contributions from the employee and premiums for supplementary guarantees are not included in this.
  • The employer can only grant an IPT if all staff members benefit from a supplementary pension plan. This can be a company pension scheme, or a sector pension scheme.

Obligation to report the conclusion of an IPTL before 31 March following the year of subscription

Organizers must report annually to the Authority for Financial Services and Markets (FSMA) the number of IPTL contracts granted in the past calendar year. In doing so, they also report a number of characteristics of the supplementary pension plans for the relevant category of staff members. This allows the FSMA to check whether the commitment was indeed made on an 'occasional' basis. The reporting of the individual pension commitments must take place before 31 March following the year of subscription to the FSMA via the model form WAP4.
